Appeals Court denies request to stop Douglas County Home Rule Election

This decision is the third to uphold the right of citizens to vote on Home Rule

The Appeals Court is the most recent court to uphold Douglas County citizens’ right to vote on local control during a special election on June 24.

State Rep. Bob Marshall and Douglas County residents Lora Thomas and Julie Gooden filed legal action against the Board of Douglas County Commissioners in April, seeking to halt the Home Rule Special Election – a district court judge declined to take immediate action.

Three court orders have denied their claims:

“As your Board of County Commissioners, we remain steadfast in our commitment to defending our elections and the fundamental rights of every voter in Douglas County. We will not be deterred by the actions of those who seek to undermine our citizens’ right to vote,” said Douglas County Commissioner and Board Chair Abe Laydon. “Together, we will continue to champion the voices of our community, protecting local control, and ensuring that the principles of fairness and integrity guide our elections. Thank you to the Colorado Court of Appeals for standing strong in defense of democracy.”

“This isn’t just another court ruling; it’s the third strike for Lora Thomas, who seems to think our courts are her personal playground. She’s tried to weaponize our judicial system against the very people she once claimed to represent, costing our county hundreds of thousands of dollars in the process. And each time, she’s been met with a resounding “not today” from our courts,” said Douglas County Commissioner George Teal. “It’s a lesson in democracy that Ms. Thomas seems to have missed.”

“Despite the efforts of a few outside activists who seek to disrupt our local governance, the voters of Douglas County are actively casting their ballots. They are choosing their own path and exercising their right to local control. This is a powerful demonstration of democracy in action, and it’s essential that we continue to support and protect this process,” said Douglas County Commissioner Kevin Van Winkle. “As your Board of County Commissioners, we will remain steadfast in our commitment to defending our elections and the fundamental rights of every voter in our county.”

About Home Rule
Unlike statutory counties that must adhere to all state-imposed laws, the Colorado Constitution grants Home Rule Counties greater local control to address important issues of local concern. On March 25, the Board of Douglas County Commissioners hosted a public meeting to initiate the nine-step process for Douglas County to develop its own Home Rule Charter.
