Your feedback is the next step as the Board of Douglas County Commissioners considers an ordinance focused on addressing construction defect litigation in unincorporated Douglas County.

The construction of new homes in Douglas County is essential for the long-term well-being of our community. Homeownership is a major factor in the health, safety, and financial well-being of residents and allows for families at every stage of life to find a property that fits their needs.

Obstacles such as construction defect litigation often prevent the construction of new homes of varying size, such as condos or townhomes, which can negatively impact first-time homebuyers looking to get into the market or older adults looking to downsize.

That is why the Board, at a Business Meeting on Tuesday, Nov. 18, introduced an ordinance to curb unnecessary litigation related to construction defects. Ultimately, the ordinance is aimed at empowering homeowners, holding builders accountable – while allowing for a right to repair (rather than be sued) – and encouraging the construction of a variety of housing stock.

“What this is really about is helping our citizens begin building the primary building blocks of wealth – being able to buy a home instead of renting,” said Commissioner Abe Laydon. “We think this is a good first step.”

“This is an effort to free people from one of the most irrational and harmful home policies in the nation,” said Commissioner Kevin Van Winkle, referring to current state laws around construction defects. “It’s that first chance to really own something, instead of paying endless rent. It’s older adults who no longer want to maintain a large home or yard and want to move into something more modest. We look forward to the public comment between now and second reading.”

This was the first reading of the ordinance, which officially introduces the idea to the public. Public comment is welcome and encouraged. A final reading of the ordinance will be scheduled at a later date.
