Douglas County Local Coordinating Council (LCC)

Mission

The mission of Douglas County Transit Solutions (DCTS) is to collaboratively develop resources to meet mobility needs.

Formation

On February 2, 2012, Douglas County’s Local Coordinating Council (LCC) was established through a Memorandum of Understanding among 20 founding member organizations, including jurisdictions, key transit providers, and relevant community organizations.  Membership has continued to expand.

A LCC is a formal, multi-purpose, long-term alliance of community organizations, individuals, and interest groups that work together to achieve common goals regarding public transportation.  An LCC implements and oversees the provision of coordinated transportation in their community or region.  The establishment of LCC’s in communities across the state is a focal point in CDOT’s strategy to improve the coordination of public transportation programs.

Title VI - Civil Rights

Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, and national origin in programs that receive federal funds.

Title I and II - Americans with Disabilities Act

Title I and II of the Americans with Disabilities Act (ADA) of 1990 states that people with disabilities cannot be treated unfairly when using transportation services.

Federal Transit Law, 49 USC 5332(b) prohibits discrimination based on religion, sex and age.

Disadvantaged Business Enterprise

Disadvantaged Business Enterprise (DBE) requires Federal Transit Authority (FTA) funding recipients to comply with the DBE regulations.

Reasonable Modification Policy

If you would like to request a reasonable modification to Douglas County policies, practices and/or procedures to assist in ensuring that our programs are accessible to individuals with disabilities, please send a request describing what is needed to use the service to the Douglas County Mobility Manager at 303-814-4326 or at [email protected].  Staff will use the following criteria to determine if a request is reasonable:

  1. The request does not change the service completely;
  2. The request is not unsafe;
  3. The request must be necessary for you to use the services; and
  4. The request does not cost too much or is not too difficult to do.

Language Access

It is Douglas County’s policy to provide language assistance for people who do not speak English well so they may have access to programs and services normally provided in English. Language assistance is provided so as not to discriminate based on national origin in violation of Title VI. Douglas County will provide appropriate alternative non-English formats for free to persons with Limited English Proficiency (LEP) to access information and services.

Douglas County will provide free language assistance services when a LEP person requests them. Any organization that receives federal funding from Douglas County is required to have a Language Assistance Plan in place or to utilize this plan to comply with federal requirements.

Filing a Complaint

Who is eligible to file a complaint?

Anyone who feels they were treated unfairly, harassed, retaliated against, or denied services because of their race, color, national origin, age, sex, or disability may file a complaint.

Unfair treatment includes lack of access, harassment, retaliation and unequal impacts from a program or activity. Harassment includes abusive and humiliating verbal or physical behaviors. Retaliation includes intimidating, threatening, coercing, or engaging in other biased conduct against anyone because they filed a complaint or otherwise participated in a discrimination investigation.

How is a complaint filed?

Title VI complaints must be filed in writing within 180 days from the last date of the alleged discrimination, unless the time for filing is extended by the processing agency. Though not required, complainants are encouraged to use the Title VI Discrimination Complaint Form.

The Douglas County Department of Community Services must forward any Title VI complaint to the Colorado Department of Transportation (CDOT) within three (3) business days. CDOT will then forward the Title VI complaint to the FTA Civil Rights Office for further processing.

Once an FTA Title VI complaint is received, Douglas County Department of Community Services will log the complaint information in its records. After forwarding the complaint to CDOT, Douglas County Department of Community Services will provide the complainant with the name and contact information of the CDOT employee responsible for coordinating the complaint.

FTA Office of Civil Rights will determine whether a Title VI complaint is accepted or dismissed, as well as whether FTA or CDOT will investigate the complaint. FTA Office of Civil Rights will notify the complainant, as well as appropriate agencies, on its decision.

ADA complaints must be filed in writing within 60 days from the last date of the alleged discrimination, unless the time for filing is extended by the processing agency. Within 15 calendar days after receipt of the complaint, the ADA Coordinator or his/her designee will meet with the complainant to discuss the complaint and possible resolution. Within 30 calendar days of receipt of the complaint, the ADA Coordinator or his/her designee will respond in writing, and, where appropriate, in a format accessible to the complainant. The response will explain the position of Douglas County and offer options for substantive resolution of the complaint.

If the response by the ADA Coordinator or his/her designee does not satisfactorily resolve the issue, the complainant may appeal the decision within 15 calendar days after receipt of the response to the County Manager. Appeals should include any additional information for review and reason for reconsideration.

Within 15 calendar days after receipt of the appeal, the County Manager will meet with the complainant to discuss the complaint and possible resolution. Within 30 calendar days after receipt of the appeal, the County Manager will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.

Reasonable efforts will be made to assist persons with disabilities, non-English speakers, and others unable to file a written complaint.
